Hi Dan, I'm open to running for a position on the board. As for the number of votes for a special assessment first we look to our bylaws to determine quorum requirements. Article 4 section 4. A quorum shall be deemed to have been present for purposes of the vote if members having one-third of the total votes cast ballots in any such election We have 31,962 total acres = 31,962 total votes To meet the quorum we need at least 1/3 of the total votes to cast ballots. 31,962 / 3 = 10,654 The first hurdle to raising a special assessment is 10,654 vote acres must be cast at a minimum (which will never happen) That would be about 267 owners returning ballots if we assume an average lot size of 40 acres. Next, we look to the voting requirements for special assessment found in our CC&R under article 3 property owners association, section H In addition to the regular assessment as set forth above, the Association may set special assessments if the association determines by two-thirds vote Let's assume for argument's sake that the minimum quorum is met. 2/3 of those votes returned would need to be in favor of a special assessment 10654 * 2/3 = 7,102.66 7103 votes acres at a minimum would be required to raise a special assessment if the quorum is met. In other words, out of the 267 owners mentioned above returning ballots, 178 would have to agree to raise special assessments. I believe the last election we had about 117 members TOTAL vote/ return ballots. Feel free to direct our president and all members of the board to this post. They have squandered enough money this year on unnecessary legal fees.
