Update on the Ballot Issue
WE have been researching the ballot issue discussed in the previous post and found that this issue does arise from time to time in other HOA/POA communities. We found a precedent which seems to make sense to follow.
Under normal circumstances all votes would be tallied to identify the top 4 candidates based on acre votes. We will proceed as usual. If Jerry Grubb is not one of those candidates, then no further action is required.
If Jerry is one of the top 4 candidates, we move to the candidate in 5th position to take a Board position.

There are several forums that offer legal and procedural advice related to HOAs, either for homeowners with questions or concerns or for HOA/POA members asking for guidance on a particular topic. They all offered similar advice. The one quoted above was the clearest, in plain English. We wanted to avoid legal fees if possible but can certainly ask the POA attorney for advice if it will make people more comfortable.
